Terms and Conditions

Bonne Route Limited has written these Terms and Conditions with fairness to all parties in mind. Please read them carefully and make sure you understand the basis of the contract into which you are entering.

1. Booking an adventure - a fully-completed and submitted online booking form or fully completed and signed paper-copy booking form, together with payment to the value of fifty (50) per cent of the total holiday cost is payable at the time of reservation (unless stated otherwise in individual tour details). The person submitting/signing the booking form is responsible for the consent of all persons named on the booking form and monies owed to Bonne Route Limited for the total holiday cost. It is also the responsibility of this person to liaise with any other members of their party and keep them informed of their obligations concerning this contract and inform them to read the Bonne Route Limited Terms and Conditions. Your booking will be confirmed in writing by us which will contain full details of the holiday and what we are providing. By submitting/signing the booking form you are accepting our Terms and Conditions.

2. Balance payment - the balance of the total holiday cost (remaining fifty (50) per cent) must be paid in full no later than eight (8) weeks before the departure date. If the balance is not received by this date, we reserve the right to cancel the booking and apply cancellation charges, as detailed in 'cancellations by you'.

3. Pricing - all prices for holidays contained on this web site are fully inclusive for the services we have agreed to provide, which are fully detailed in our booking acceptance letter. Any extras are payable by each individual who requests them. Where meals are included in the holiday price, they do not generally include beverages and/or 'extra' items. All prices are based on the Sterling/Euro exchange rate in force at the time the tour is published on the web site. The price of your holiday may be subject to surcharges for any of the following reasons - variations in transport costs (including fuel surcharges), currency fluctuations, variations in accommodation costs, or variations in costs for event entry. Generally, if the costs to us increase by less than five (5) per cent they will be absorbed by Bonne Route Limited. If the costs to us increase by more than five (5) per cent, then we will advise you of any additional costs to your holiday. Should you decide to cancel for this reason, you must inform us within fourteen (14) days of our notification, otherwise cancellation charges will apply, as detailed in 'cancellations by you'.

4. General Exclusions - each individual adventure contains a description of what is included in the tour price. Any extra items not listed in the individual tour itinerary shall be payable by you. Examples of extra's are, but not limited to: - drinks, newspapers, room service, menu variations, breakdown costs, other accommodation and meals outside those included in the individual package, fuel, tolls and personal expenses. You must settle in full any outstanding amounts before checking out from a hotel. Ferry crossings - if you miss any prearranged ferry crossings or other third party carriage included in the tour package, it is your responsibility to pay for any additional costs incurred.

5. Changes by you to your booking - if you wish to change your booking in respect of number or names of persons wishing to travel, then you must inform us immediately in writing. If we can accommodate your request we will do so, but it may involve a re-booking (without refunding any monies already paid) or it may incur administration charges instead. Currently our administration charges for changes to bookings amount to fifty pounds (£50) per person per alteration.

6. Cancellation by you - in the event that you, or any member of your party needs to cancel your booking (or part of it) once it has been confirmed by us, you must do so in writing. Cancellation charges will apply as detailed below, which will depend on the date we receive the notification:

7. If we change your holiday - if, due to circumstances beyond our control, we need to effect changes to your holiday, we will inform you at the earliest opportunity. If we have to make a change to your hotel accommodation or time of departure or return due to acts or threats of war, riots or civil strife, industrial disputes, adverse weather conditions, fire, flood, disaster, terrorist activities, cancellation or schedule changes by ferry operators or similar events beyond our control, we will have no liability for any costs incurred by you.

8. Cancellation by Bonne Route - in the unlikely event, that due to circumstances beyond our control, we have to cancel your holiday, we will refund in full any monies paid by you to Bonne Route Limited (but excluding any unearned interest, or 'extras').

9. Immediate Termination by Us - if your behaviour (or the behaviour of any member of your group as described on your booking form) is unacceptable, we may terminate your holiday immediately without any refund, form of compensation, or costs incurred by you as a direct result of the termination. The term 'unacceptable behaviour' includes, but is not limited to, dangerous, careless or reckless driving, driving while under the influence of alcohol, drugs, or other substance, driving a poorly maintained vehicle, verbal or physical abuse to any person or behaviour that may be deemed as 'anti-social' which may cause offence or distress to others, or damage to property.

10. Travel Delays etc - Bonne Route Limited shall not be responsible for any cost to the client incurred as a result of foreseen or unforeseen travel delays either prior to, or during the holiday. No credit or refund shall be given for any unused part of your holiday or services.

11. Travel Insurance - Bonne Route Limited do not provide any form of travel insurance. We advise you and any member of your party to obtain full travel insurance for your holiday, and to read the full terms and conditions of the policy to ensure you are adequately covered. If you mislay, lose, or destroy your travel documents, Bonne Route Limited shall not be liable for any costs incurred by you.

12. Image Rights - in participating on a tour you agree to have photographs and cinematic footage taken of you and your property and agree to allow Bonne Route Limited the use of these images for its web site or other promotional purposes such as magazines and leaflets without any charge.

13. Luggage - luggage is the sole responsibility of the owner. Bonne Route Limited does not; under any circumstances accept responsibility for the luggage of any member of the tour group.

14. Complaints - if you feel you have good cause to complain at any time prior or during your holiday please advise us immediately. We will thoroughly investigate your complaint and take the necessary steps to resolve the problem. We do not accept complaints after completion of your holiday unless this complaint was brought to our attention during your holiday and is sent to us in writing within 3 weeks of the final day of your holiday.

15. Our Liabilities - to the fullest extent permitted by law, all warranties relating to the provision of goods or services by us to you, or any member of your party, are excluded, and we shall not have liability to you, except as otherwise expressly set out in these Terms and Conditions, for any damages, liabilities, injuries, or other losses suffered by you, any member of your party, your property, or the property of any member of your party, except to the extent caused by negligence, wilful default, or fraud by us or our employees, agents and representatives. Except as otherwise expressly set out in these terms and conditions, our total liability to any person for any claim or series of claims arising from any negligent act or negligent default or series of negligent acts or negligent defaults shall not exceed the cost of the holiday for that person.

Nothing in these terms and conditions shall, or be deemed to exclude our liability for death or personal injury resulting from our negligence. You or the relevant member of your party shall be responsible for all penalties, fines and other costs and expenses incurred during the holiday and if to this extent we are also held liable for such fines, damages, penalties and other costs and expenses, you will indemnify us and promptly upon our request pay any amounts we pay, or may have to pay in respect thereof. In participating on a tour, you do so voluntarily and in the full knowledge that any accident, injury or other incident to you or third parties as a result of your actions is entirely your responsibility and liability and you therefore indemnify Bonne Route Limited and its Directors and Officers in full against any claim brought about by you, a member of your party or a third party.

16. Third Party Liabilities - where part of your holiday involves travel using a third party, for example ferry crossing, then this part of your holiday is subject to the Terms and Conditions of the applicable third party, and Bonne Route Limited accepts no responsibility whatsoever.

17. Law - these conditions form part of the contract between us, which will be construed in accordance with English Law and it is agreed that each will submit to the jurisdiction of the English Courts.
